Terms and Conditions

1. Scope of application

These Terms and Conditions govern access to, browsing and use of the MIPMED website, as well as purchases made through its online store.

By using this website and/or completing an order, the user declares that they have read, understood and accepted these Terms and Conditions.

3. Products and commercial information

MIPMED seeks to ensure that all information presented on the website, including descriptions, images, prices and technical specifications, is clear, accurate and up to date.

However, occasional errors, typographical mistakes, temporary unavailability or presentation changes introduced by manufacturers may occur. MIPMED reserves the right to correct or update any information on the website without prior notice.

The images shown are for illustrative purposes only and may not fully reproduce the final appearance of the product.

 

4. Prices

All prices shown on the website are in euros (€) and include VAT at the legal rate in force, unless expressly stated otherwise.

Shipping costs, when applicable, are displayed before the order is completed.

MIPMED reserves the right to change prices, promotions and commercial conditions at any time. However, confirmed orders will be processed based on the price shown at the time of purchase, except in cases of obvious error.

 

5. Orders

An order is considered submitted once the purchase process has been correctly completed on the website.

After the order is received, the customer will receive a confirmation by email. Final acceptance of the order depends on payment confirmation, stock availability and validation of the information provided.

MIPMED reserves the right to refuse, cancel or adjust orders, in whole or in part, in situations involving product unavailability, technical error, obvious pricing error, suspected fraud or inability to process the order.

 

6. Payment methods

MIPMED offers the following payment methods in the online store:

  • Cash on delivery (additional €2.00)

  • Google Pay

The order will only be processed after payment has been confirmed, when applicable.

In the case of cash on delivery, an additional charge of €2.00 will apply.

MIPMED reserves the right to update, add or remove available payment methods at any time, without affecting orders already completed.

 

7. Stock and availability

Product availability shown on the website may change without prior notice.

In the event of stock shortages, supplier delays or inability to dispatch the order, MIPMED will inform the customer as soon as possible and may propose a new delivery timeframe, partial shipment, replacement with an equivalent product or cancellation with refund of the amount paid.

 

8. Deliveries

Shipping conditions, estimated delivery times and shipping costs are detailed on the Delivery Information page.

The deadlines shown are estimates and may vary due to logistical reasons, occasional stock shortages, promotional periods, carrier delays or other circumstances beyond MIPMED’s control.

The customer is responsible for ensuring that delivery details are correct and complete at the time of ordering.

 

9. Returns

If the customer wishes to return one or more items, they may do so, in addition to the statutory 14-day period after receiving the order, provided that the products are intact, sealed, complete and in their original packaging, which must not be damaged, altered or scratched, and that the products are not past their expiry date or close to expiring.

For reasons of health protection and hygiene, returns of sealed items that have been opened after delivery will not be accepted (for example: invasive medical devices, nursing consumables, creams or gels).

 

10. Damaged, defective or non-compliant products

If the customer receives a damaged, defective or incorrect product, they should contact MIPMED as soon as possible, preferably in writing, stating the order number and describing the situation.

Whenever possible, photographs of the product and packaging should be provided to allow for faster assessment.

After verification, MIPMED will adopt the appropriate solution, which may include replacement, refund or another proportional measure suited to the situation.

 

11. Refunds

In compliance with Articles 10 and 11 of the legal regime applicable to distance and off-premises contracts, the customer may exercise their right of withdrawal within 14 days from the day on which they acquire physical possession of the ordered product or, if the order consists of multiple items delivered on different days, from the day on which they acquire physical possession of the last item delivered. To exercise this right, the customer must send MIPMED, before the expiry of the above period, an unequivocal statement of withdrawal from the contract.

MIPMED will issue a full refund of any amount paid by the customer, excluding the return shipping costs. A member of the MIPMED Customer Support team will contact the customer to confirm the right to a refund and to provide any additional clarification on this matter.

 

12. Warranties

Products sold by MIPMED benefit from the warranties legally applicable.

The warranty does not cover situations resulting from incorrect use, normal wear and tear, improper storage, misuse or use different from that intended by the manufacturer.

 

13. Use of the website

The user undertakes to use the website lawfully, responsibly and in compliance with applicable legislation.

Any use of the website that may compromise its operation, security, integrity or reputation is prohibited, as is any reproduction, copying or misuse of its contents without prior authorisation.

 

14. Intellectual property

All website content, including texts, images, photographs, design, logos, trademarks, graphics and structure, is the property of MIPMED or duly authorised third parties and is protected by intellectual property rights.

Its reproduction, use or disclosure, in whole or in part, without express authorisation is prohibited.

 

15. Cookies and personal data

Use of the website implies the processing of personal data and the use of cookies, in accordance with the terms set out in the current Privacy Policy.

 

16. External links

The MIPMED website may contain links to third-party websites. MIPMED is not responsible for the content, functioning or policies of such external websites.

 

17. Limitation of liability

To the fullest extent permitted by law, MIPMED shall not be liable for damages resulting from technical failures, temporary unavailability of the website, service interruptions, IT errors, improper use of the platform by third parties or force majeure events.

Nothing in these Terms and Conditions excludes liabilities that cannot be excluded by law.

 

18. Complaints Book and dispute resolution

MIPMED provides a Complaints Book, including in electronic format, through www.livroreclamacoes.pt.

In the event of a dispute, we inform consumers that they may use the Consumer Alternative Dispute Resolution entities identified on the consumer portal at www.consumidor.gov.pt, or the Online Consumer Dispute Resolution platform identified at www.consumer-redress.ec.europa.eu. As MIPMED is based in Braga, special mention should be made of CIAB – Consumer Arbitration Court (www.ciab.pt).
